CONTRACT DOCUMENTS<\/strong><\/p>\n 2.1. By registering an Order on the Website, the Buyer agrees to the form of communication (telephone or email), if applicable, through which the Seller carries out its commercial operations.<\/span><\/p>\n 2.2. he notification received by the Buyer after sending the Order is for information purposes and does not represent an acceptance of the Order. The notification is submitted electronically (by email) or by phone.<\/span><\/p>\n 2.3. For justified reasons, the Seller reserves the right to change the quantity of Goods and\/or Services in the Order. The Seller has the right to change, for due cause, the quantity of the Goods and\/or Services included in the Order. If the Seller changes the quantity of the Goods and\/or Services included in the Order, it will notify the Buyer at the email address or telephone number provided to the Seller at the time of the Order and will return the amount paid.<\/span><\/p>\n 3. ONLINE SALES POLICY<\/strong><\/p>\n 3.1. Access is allowed to any User\/Buyer planning to submit an Order.<\/span><\/p>\n Wonderland Cluj has the right to restrict, for due cause, the User\u2019s\/Buyer\u2019s access required for making an Order and\/or the User\u2019s\/Buyer\u2019s access to some of the accepted payment methods, if it believes that, based on the User\u2019s\/Buyer\u2019s conduct or activity on the Website, their actions could harm Wonderland Cluj in any way. In any of these situations, the User\/Buyer can contact the Customer Service Department of Wonderland Cluj to be informed of the reasons for the above-mentioned measures.<\/span><\/p>\n 3.2. The communication with the Seller may take place by direct interaction with the Seller or through the addresses included in the \u201cContact\u201d section of the Website. The Seller can handle the information received at its discretion, without having to provide any explanation.<\/span><\/p>\n 3.3. All the rates related to the Goods and\/or Services presented on the Website are expressed in lei (RON) and include VAT.<\/span><\/p>\n 3.4. In case of online payments, the Seller is not\/cannot be held liable for any other additional costs incurred by the Buyer, including, but not limited to, the currency conversion fees applied by the bank which issued the card, if the card currency is other than lei (RON). The Buyer is solely responsible for this action.<\/span><\/p>\n 3.5. The information used to describe the Goods and\/or Services available on the Website (static \/ dynamic images \/ multimedia presentations, etc.) is not a contractual obligation of the Seller, as this can only be used for presentation purposes.<\/span><\/p>\n 4. TRANSFER AND SUBCONTRACTING<\/strong><\/p>\n 4.1. The Seller may transfer and\/or subcontract the Services required to fulfil an order to a third party, by notifying the Buyer, whose consent is not required. The Seller shall always be responsible to the Buyer for all the obligations under the contract.<\/span><\/p>\n 5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS<\/strong><\/p>\n 5.1. The content, as defined in the recitals, including but not limited to, the logos, stylized representations, commercial symbols, static images, dynamic images, text and\/or multimedia content presented on the Website, are the sole property of Wonderland Cluj and all the rights directly or indirectly obtained in this respect are reserved to Wonderland Cluj.<\/span><\/p>\n 5.2. The Client\/Buyer\/User may not copy, distribute, publish, transfer to third parties, modify and\/or otherwise alter, use, link to, expose, incorporate any content in any context other than the original one intended by Wonderland Cluj, may not incorporate any content outside the Website, may not remove any marks specific to Wonderland Cluj\u2019 copyright over the content, and may not participate in the transfer, sale, distribution of materials by reproducing, modifying or displaying the content, unless Wonderland Cluj has given its written consent in advance.<\/span><\/p>\n 5.3. The Client\/Buyer\/User may only copy, transfer and\/or use the content for personal or non-commercial purposes, provided that this does not conflict with the provisions of the document.<\/span><\/p>\n 5.4. No Content sent to the Client, User or Buyer by any means of communication (electronic, telephone, etc.) or acquired by them by accessing, visiting and\/or viewing, shall be a contractual obligation of Wonderland Cluj and\/or the Wonderland Cluj employee mediating the Content transfer, if any, in relation to that content.<\/span><\/p>\n 6. ORDER<\/strong><\/p>\n 6.1. The Customer\/Buyer may place Orders on the Site, by adding the desired Goods and\/or Services to the shopping cart and completing the Order by making payment by one of the methods expressly indicated. Once added to your shopping cart, a Good and\/or Service is available for purchase to the extent that there is stock available for it. The addition of a Good\/Service to the shopping cart, in the absence of the completion of the Order, does not entail the registration of an order, nor the automatic reservation of the Good\/Service.<\/span><\/p>\n 6.2. By completing the Order, the Buyer agrees that all data provided by the Buyer necessary for the purchase process is correct, complete and true at the time of placing the Order.<\/span><\/p>\n 6.3. The Seller may cancel the Order placed by the Buyer, upon prior notice to the Buyer, without any further obligation of either party to the other or without either party being entitled to claim damages against the other in the following cases:<\/span><\/p>\n 6.4.1. non-acceptance by the Buyer’s card-issuing bank of the transaction in the case of online payment;<\/span><\/p>\n 6.4.2. invalidation of the transaction by the card processor approved by Wonderland Cluj, in case of online payment;<\/span><\/p>\n 6.4.3. the data provided by the Client\/Buyer on the Site are incomplete and\/or incorrect;<\/span><\/p>\n 6.5. If a Good and\/or Service ordered by the Buyer cannot be delivered by the Seller, the Seller shall inform the Customer\/Buyer of this fact and shall return to the Buyer’s account the consideration for the Good and\/or Service within a maximum of 30 (thirty) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed its intention to terminate the Contract.<\/span><\/p>\n 7. PRIVACY<\/strong><\/p>\n 7.1. Wonderland Cluj will keep confidential any information of any nature that you provide. Disclosure of the information provided may only be made under the conditions set out in this Document.<\/span><\/p>\n 7.2. No public statement, promotion, press release or any other disclosure to third parties shall be made by Buyer\/Customer with respect to the order\/contract without Seller’s prior written consent.<\/span><\/p>\n 7.3. By submitting information or materials through this site, you grant Seller unrestricted and irrevocable access to, and the right to use, reproduce, display, modify, transmit and distribute such materials or information. You also agree that Seller may freely use, for its own purposes, any such information, ideas, concepts or techniques that you submit to us through the Site. Wonderland Cluj will not be subject to any obligations regarding the confidentiality of the information submitted, unless otherwise specified by law.<\/span><\/p>\n 8. COMMERCIAL COMMUNICATIONS<\/strong><\/p>\n 8.1. The Buyer\/User\/Customer may at any time change his\/her choice regarding the consent given to the Seller for Commercial Communications containing general and thematic information including information on offers or promotions by contacting the Seller.<\/span><\/p>\n The Seller will send the Buyer\/User Commercial Communications regarding:<\/span><\/p>\n – when the price of the Goods or Services added in the “My Cart” section changes,<\/span> 9. INVOICING – PAYMENT<\/strong><\/p>\n 9.1. The prices of Goods and Services displayed on the www.wonderland.ro website include VAT according to the legislation in force.<\/span><\/p>\n 9.2. The price, payment method and payment term are specified in each Order. The Seller shall issue an invoice to the Buyer for the Goods and Services delivered, and the Buyer is obliged to provide all the information required to issue the invoice in accordance with applicable law.<\/span><\/p>\n 9.3. The Seller shall send to the Buyer at the Buyer’s request the invoice for the Order containing Goods and\/or Services sold by Wonderland Cluj, except for Goods and\/or Services sold by Wonderland Cluj partners, and for any other payments related to the Order, exclusively in electronic format, by adding the invoice to the Buyer’s Account or by electronic mail, to the e-mail address mentioned by the Buyer in his Account.<\/span><\/p>\n 9.4. By submitting the Order, the Buyer agrees to receive the invoices in electronic format by having Wonderland Cluj add them to the Account or by electronic mail to the e-mail address mentioned in his Account.<\/span><\/p>\n 9.5. If this information is unavailable for more than 48 (forty-seven) hours in the Account, please notify us by email: receptie@wonderland.ro<\/span><\/p>\n 9.6. The payment card data of the User\/Buyer will not be accessible to Wonderland Cluj and will not be stored by Wonderland Cluj or by the payment processor integrated in the Site, but only by the institution authorizing the Transaction or another entity authorized to provide card identification data storage services, of whose identity the User\/Buyer will be informed, prior to entering the data.<\/span><\/p>\n 9.7. In some cases, in order to maintain the security of Transactions, the Buyer will be required to authorize payment by re-entering the password for the Account or using the fingerprint in the case of mobile terminals that have this facility when registering the Order.<\/span><\/p>\n 9.8. For security reasons, the User\/Buyer is advised not to remain logged in to the Site and not to set the automatic login option on mobile devices. Disclosure of account passwords is not permitted and it is recommended that you use a strong security password (e.g., at least eight characters, including uppercase letters, lowercase letters, digits and special characters).<\/span><\/p>\n 10. LIABILITY<\/strong><\/p>\n 10.1. The Seller shall not be liable for damages of any kind which the Buyer or any third party may suffer as a result of the Seller’s performance of any of its obligations under the order and for damages resulting from the use of the Goods and Services after delivery and in particular for loss thereof.<\/span><\/p>\n 10.2. By creating and using the Account, the User\/Buyer assumes responsibility for maintaining the confidentiality of the Account data (user and password) and for managing access to the Account and, to the extent permitted by applicable law, is responsible for the activity carried out through his\/her Account.<\/span><\/p>\n 10.3.
